Terms of Service

These terms of service ("Terms") apply to the use of the service TermSlayer ("the Service"), provided by chapter42.com, registered at waldeckstraat 1a 7513 BR ENSCHEDE The Netherlands, registered with the Dutch Chamber of Commerce under number 08209536 ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. Definitions

Service
The web application TermSlayer, accessible at termslayer.com, including all associated functionalities.
User
Any natural or legal person who creates an account and/or uses the Service.
Credit
A digital unit that entitles the User to perform one analysis.
Analysis
A search intent analysis based on a keyword and country entered by the User.
Page Audit
An analysis of a URL provided by the User compared to the SERP results.

2. Account registration

  • 2.1 To use the Service, you must create an account with a valid email address.
  • 2.2 You are responsible for keeping your login credentials confidential and for all activities that occur under your account.
  • 2.3 One person or organization may have at most one account. Creating multiple accounts to obtain free credits is not permitted and may result in suspension of all related accounts.

3. The Service

  • 3.1 TermSlayer provides AI-powered search intent analysis as a service. The Service analyzes Google search results, scrapes the content of ranking pages and generates insights and recommendations using AI.
  • 3.2 We endeavor to keep the Service available and reliable, but do not guarantee 100% availability (uptime). We will announce planned maintenance in advance where possible.
  • 3.3 Analysis results are generated by AI and are indicative. We do not guarantee the accuracy, completeness or suitability of the results for any specific purpose.

4. Credits and payments

4.1 Credit system

  • The Service operates on a pay-per-analysis credit system.
  • 1 credit = 1 analysis.
  • New users receive 5 free credits upon registration.

4.2 Purchase

  • Credits can be purchased through the Service in pre-defined packages.
  • Prices are in euros and include VAT (21%), unless otherwise stated.
  • Payments are processed via Stripe (credit card, Apple Pay, Google Pay) or via invoice (Moneybird, for business customers in the Netherlands).

4.3 Credit expiration

  • Purchased credits expire 6 months after the purchase date.
  • Free credits (welcome credits, coupons) do not expire.
  • We send email reminders 30 days and 7 days before credits expire. You can extend credits via a link in these emails.

4.4 Refunds

  • Used credits are non-refundable.
  • For unused credits, the statutory right of withdrawal of 14 days applies (Art. 6:230o Dutch Civil Code), provided the credits have not been used.
  • After the 14-day withdrawal period, unused credits are non-refundable.
  • If you start an analysis during the withdrawal period, you consent to the immediate commencement of service delivery and you waive the right of withdrawal for the credits used.

4.5 VAT and invoicing

  • Prices include 21% Dutch VAT, unless a valid EU VAT number is provided. In that case, the reverse charge mechanism applies.

5. Acceptable use

  • 5.1 You may only use the Service for lawful purposes.

5.2 The following is not permitted:

  • Automated access to the Service (scraping, bots) outside of the provided interfaces.
  • Circumventing credit limits or security measures.
  • Using the Service for unlawful or harmful activities.
  • Creating multiple accounts to abuse free credits.

5.3 Violations may result in immediate suspension or termination of your account, without refund of remaining credits.

6. Intellectual property

  • 6.1 The Service, including the software, design, branding and documentation, is the property of chapter42.com and is protected by copyright and other intellectual property rights.
  • 6.2 You may freely use the analysis results generated by the Service for your own personal or business purposes.
  • 6.3 You do not grant us any ownership or license rights to the keywords or URLs you enter, except the right to process them for the purpose of the Service.

7. Liability

  • 7.1 The Service is provided "as is". We are not liable for any damage arising from the use of, or reliance on, analysis results.
  • 7.2 Our total liability is limited to the amount you have paid us in the 12 months preceding the event giving rise to the liability, with a maximum of EUR 500.
  • 7.3 This limitation does not apply to damage caused by our intent or gross negligence.
  • 7.4 We are not liable for indirect damage, consequential damage, lost profits or missed savings.

8. Availability and maintenance

  • 8.1 We strive for high availability of the Service, but do not guarantee it.
  • 8.2 We may temporarily interrupt the Service for maintenance, updates or emergencies.
  • 8.3 We are not liable for any damage resulting from unavailability of the Service.

9. Termination

  • 9.1 You can delete your account at any time via your account settings.
  • 9.2 We may suspend or terminate your account if you act in violation of these Terms.
  • 9.3 Upon termination, your remaining credits will not be refunded, unless the termination is attributable to us.

10. Changes

  • 10.1 We may amend these Terms. In the event of material changes, we will inform you by email or via a notice in the application, at least 14 days before the change takes effect.
  • 10.2 If you do not agree with the amended Terms, you may delete your account before the effective date of the change.

11. Governing law and disputes

  • 11.1 These Terms are governed by Dutch law.
  • 11.2 Disputes shall be submitted to the competent court in Enschede, unless mandatory law provides otherwise.
  • 11.3 Consumers may also submit a dispute to the European Online Dispute Resolution platform (ODR): https://ec.europa.eu/consumers/odr.
